1. Agreement
These Terms of Service ("Terms") govern your use of the TalkU mobile application and related services ("TalkU", "we", "us", or "our"). By downloading, accessing, or using TalkU, you agree to these Terms and our Privacy Policy. If you do not agree, do not use TalkU.
2. Eligibility
TalkU is intended for business and professional use. You must have the legal capacity to enter a binding agreement in your jurisdiction. If you use TalkU on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials.
- You must provide accurate account information and keep it up to date.
- You are responsible for activity that occurs under your account.
- Notify us immediately at support@talku.app if you suspect unauthorized access.
- You may delete your account at any time through in-app settings or by contacting support.
4. Acceptable Use
You agree not to:
- Use TalkU for unlawful, fraudulent, or harmful purposes;
- Upload content that infringes intellectual property or privacy rights of others;
- Attempt to reverse engineer, disrupt, or compromise TalkU systems or security;
- Use automated means to scrape or overload the service without permission;
- Share account access in a way that violates your organization's policies or applicable law.
5. Your Content
You retain ownership of contacts, notes, files, and other content you submit to TalkU ("User Content"). You grant us a limited license to host, process, transmit, and display User Content solely to provide and improve the service, as described in our Privacy Policy.
You are responsible for ensuring you have the right to import, store, and process any personal data you add to TalkU, including contact information from device address books or business card scans.
6. AI and Automated Features
TalkU may offer optional AI-assisted summaries, insights, reminders, or suggestions based on content you provide. Before TalkU sends your personal data to a third-party AI service, the App will show you what data will be sent, identify the AI provider, and ask for your permission. You may decline and continue using non-AI features.
AI outputs are generated automatically and may be incomplete or inaccurate. You should review AI-generated content before relying on it for business or legal decisions. We do not guarantee the accuracy of AI outputs. See our Privacy Policy Section 5 for details on third-party AI data sharing, your consent choices, and how to withdraw consent.
7. Third-Party Services
TalkU may integrate with third-party services such as Google Sign-In, Sign in with Apple, and Firebase for authentication, notifications, and diagnostics. Optional AI features may also use third-party AI providers (such as OpenAI, Google Cloud AI, or Microsoft Azure OpenAI) as described in our Privacy Policy. Your use of those services may be subject to their own terms and policies.
8. Subscriptions and Payments
If TalkU offers paid plans or in-app purchases, pricing, billing cycles, and refund rules will be shown in the app and processed through the Apple App Store or Google Play billing systems. Subscription management and refunds follow the policies of the platform where you purchased.
9. Service Availability
We strive to keep TalkU available and reliable, but the service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features with reasonable notice when practicable.
10. Disclaimer
To the fullest extent permitted by law, TalkU is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the fullest extent permitted by law, TalkU and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the service. Our total liability for any claim relating to TalkU will not exceed the amount you paid us for the service in the twelve months before the claim, or USD $100 if no fees were paid.
12. Termination
You may stop using TalkU at any time. We may suspend or terminate access if you violate these Terms or if required for security, legal, or operational reasons. Provisions that by nature should survive termination will remain in effect.
13. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where TalkU is operated, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country provide otherwise.
14. Changes
We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Material changes may be communicated in the app. Continued use after changes become effective constitutes acceptance.
